Official Rules1. SPONSOR - The Road To The Garden Sweepstakes ("Sweepstakes") is sponsored by Viewers Choice L.L.C. ("Sponsor") and produced by Digital Marketing Associates, 150 West 28th Street, NY, NY 10001 ("Producer"). Sweepstakes begins on Saturday, February 20, 1999, at 12:01 p.m. Eastern Time (ET) and ends on Saturday, March 13, 1999, at 12:00 p.m. ET. The Grand Prize will be awarded on March 4, 1999 at 12 noon, but daily prizes will continue to be awarded through March 13, 1999. 2. ELIGIBILITY - VOID WHERE PROHIBITED - Sweepstakes is open to legal residents of the continental United States, 14 or older, who are the authorized user of an Internet email address as of February 20, 1999. If you are under 18, you must have your parent's or guardian's permission to play. Employees, officers, directors, agents, representatives, and immediate family and household members of Sponsor and Producer, and their respective parent companies, affiliates, subsidiaries, and advertising and promotion agencies, are not eligible to win. 3. HOW TO ENTER AND PLAY - NO PURCHASE NECESSARY - You may enter via The Road To The Garden Registration page, at http://www.ppv.com/tvko/ by clicking the Sign Up button. Once registered, you will be entered into daily rounds. Fighter Points: As part of the registration process, or by using the Re-Train Your Fighter option, you will enter fight characteristics of your fighter. These characteristics will be used to generate your fighter's Fighter Points at the conclusion of each round. A proprietary algorithm will determine fighter points based on the fight characteristics entered by the player. This algorithm may by changed from round to round, but will remain the same for all players within the same round. Fighter Point totals for each player are valid for one round only. Bonus Points: Players may visit game sponsors to have Bonus Points added to their total fighter points, above those calculated by the proprietary algorithm. Sponsors will be listed on the user's home page and may change between rounds. Total bonus points collect by the player will listed on the players home page. Bonus Point totals are valid for one round only. Fighter Round Total: The Fighter Round Total will be calculated by adding Fighter Points to bonus points. The Fighter Round Total is valid for one round only. Calculation of Winners Players will be randomly matched into two-player fights in each round. The player with the higher fighter points will be designated the Winner Of The Round. The Winner Of The Round will receive one entry in the Grand Prize Sweepstakes. In the event that the Fighter Round Total of the Winner Of The Round exceeds two times the total of the opponent, the win is said to be "By Knockout" and the Winner Of The Round will receive an additional entry in the Grand Prize Sweepstakes. In the event that a player cannot be matched with an opponent due to an odd number of players, a system malfunction or other unforeseen cause, the player is awarded a win for the round and an entry in the Grand Prize Sweepstakes. The Grand Prize Sweepstakes The Grand Prize will be awarded to the player with the greatest number of Grand Prize Sweepstakes entries at midnight on March 3rd, 1999. In the event of a tie among players with the most Grand Prize entries, the Grand Prize winner will be selected at random from the tied players. Daily Instant Winner Prizes will continue to be awarded through March 13, 1999. Daily Instant Winner Prizes In each round, two-player fights will be selected at random to correspond with the number of prizes available each day. The player with the highest Fighter Round Total will receive the designated Daily Prize. Winners of Daily Instant Winner Prizes will be notified on their personal home page and via e-mail, and must respond to claim their prize within three days of the conclusion of the sweepstakes. All unclaimed daily Instant Winner prizes as of the end of the Sweepstakes will be awarded via a random drawing. All of your entries may be disqualified, at the sole discretion of the Producer or the Sponsor, if you attempt (i) to enter the Sweepstakes through any means other than those set forth herein, (ii) to disrupt the game or circumvent the terms and conditions of these Official Rules, or (iii) register more than once using multiple email addresses. If any of the above occurs, the Producer has the right to remedy any such action, disruption, or circumvention in a manner to be determined solely by the Producer. 4. HOW TO QUIT - You may terminate your participation in the Sweepstakes at any time by visiting The Road To The Garden cancellation page (http://www.ppv.com/tvko/cancel.html). Every effort will be made to remove you from the Sweepstakes play list within three days of receipt of the quit request. 5. ROUNDS AND TIMING OF SWEEPSTAKES - Daily rounds will begin on Saturday, February 20, 1999 at 12:01 a.m. ET, and end on Saturday, March 13 1999 at 12:01 a.m. ET. Entries for each daily round will be accepted until 12:00 midnight, and entries received after 12 midnight will be counted as an entry for the next round. 6. PRIZES - Grand Prize: One (1) Grand prize winner will receive ********* Approximate total retail value is ********. Daily Prizes: There will be ********* Daily Prize winners. 7. SELECTION OF WINNERS - Daily Instant Winners will be determined prior to the end of each round. The random drawing for unclaimed Daily Instant winner prizes, if any, will be held on or about one week after the end of the Sweepstakes. The Grand Prize winner will be selected On March 3, 1999 at 12 noon by the method described above from among all eligible entries received. All random drawings will be held under the supervision of the Producer, whose decisions are final and binding. The Grand Prize winner will be notified on his or her home page, by e-mail, and telephone as the entry was received, within one day from the date of the drawing. If the Producer does not receive a reply to the notification announcement from the winner within two (2) days from when the notification was sent, the prize may be forfeited and an alternate winner may be selected. Daily Instant Winners will be notified online and via e-mail. The Grand Prize winner must complete, and have notarized, an affidavit of eligibility and liability and, where lawful, a publicity release (Tennessee residents need not complete and return publicity release). The winner, if under 18, must have his or her parent or legal guardian sign the affidavit and release. If the Producer does not receive the notarized affidavit and release within one week of notification, the prize may be forfeited and an alternate winner may be selected. By signing the affidavit and release, the winners (except Tennessee residents) grant permission to the use of their names, photographs, and likeness for advertising and promotional purposes for this and similar promotions without additional compensation unless required by law. The Daily Instant Prizes will be awarded within approximately four to six weeks after the end of the Sweepstakes and the receipt of all required proof and documentation. Prizes are not transferable or redeemable for cash. The Sponsor reserves the right to substitute a prize of equal or greater value. 8. CONDITIONS - The Sweepstakes is governed by these Official Rules. By participating, entrants agree to these Official Rules, and understand that the Sweepstakes results are final in all respects. All decisions regarding the Sweepstakes including, but not limited to, scoring and winner selection will be made by the Producer, whose decisions shall be final. The Producer may prohibit you from participating in this Sweepstakes or any future Producer game if, at the sole discretion of the Producer, you repeatedly show a disregard for Producer rules, or act (i) in an unsportsmanlike manner; (ii) with an intent to annoy, abuse, threaten, or harass any other player or Producer representative; or (iii) in any other disruptive manner. The winner is solely responsible for all applicable federal, state, and local taxes. All federal, state, and local laws apply. The Sponsor and Producer are not responsible for (i) lost, late, delayed, misdirected, unintelligible, or incomplete electronic and postal mail; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; or (iv) any condition caused by events beyond the control of the Sponsor and Producer that may cause the Sweepstakes to be disrupted or corrupted. By participating in the Sweepstakes, you agree to release and hold the Sponsor and Producer harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. The Sweepstakes may be terminated at the end of any round without prior notice, however, the Grand Prize will still be awarded. In the event of early termination of the Sweepstakes, the Grand Prize winner will be chosen by random drawing from among all eligible entries received to that date. 9.
